Petitioner is aggrieved by the fact that the information furnished to the Deputy Commissioner of Police, Central Division, Kolkata and the higher police officials including the local police station being New Market Police Station, was not acted upon in spite of cognizable offence having been made out. Petitioner submits that respondent no. 5 is flexing his muscles and is illegally trying to grab a portion of the property which is enjoyed by the present petitioner.

State submits a report which reflects that in respect of the information furnished on December 17, 2024, New Market P.S. Case No. 21 dated January 20, 2025 has been registered for investigation against the respondent no.5.

Learned advocate for the respondent no. 5 submits that the petitioner himself is an alien to the property as at present probate proceedings are pending.

Having considered that the civil court is already in seisin of the issues and the police authorities have already taken steps by way of registration of the FIR, I am of the view that the only recourse now available is that the police authority would keep a strict vigil and ensure that no breach of peace takes place as the petitioner and the respondent no.5 are having a strained relationship.

With the aforesaid observations, the writ petition being WPA No. 1194 of 2025 is disposed of.

The report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
