1. The petitioner alleges that no payment has been made for the construction work done by the petitioner in respect of additional 2 kms. with guard wall. The note sheet of the Office of the District Magistrate and Collector, Purulia signed by the officers of the respondent authorities mentions that the cost for the additional work has been vetted at Rs. 1,36,20,722.00/-.

2. The petitioner raised the bill for payment of the subject amount followed by several representations. Neither the payment has been made, nor any reply given to the representations filed by the petitioner.

3. None represents the respondents despite service.

4. Affidavit of service filed today is taken on record.

5. In the absence of the respondents, it is not possible for the Court to adjudicate the issue conclusively.

6. As it appears that the representation by the petitioner is pending consideration at the end of the District Magistrate, Purulia, accordingly, the instant writ petition is

disposed of by directing the respondent no. 2 being the District Magistrate, Purulia and Ex-Officio Executive Officer of the Purulia Zilla Parishad to consider the prayer of the petitioner for payment of the work done in accordance with law after giving a reasonable opportunity of hearing to the petitioner and all other necessary parties and dispose of the prayer by passing a reasoned order. If any amount is found due and payable, the same shall be forthwith disbursed in favour of the petitioner. If the claim is not admitted by the respondents, the reasons therefor shall be communicated to the petitioner. Steps shall be taken at the earliest but positively within a period of eight weeks from the date of communication of this order.

7. Learned counsel representing the petitioner is directed to forward a copy of the note sheet, the bills raised by the petitioner and the representations to the aforesaid respondent at the time of communicating the order of the Court.

8. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Amrita Sinha, J.)
