Learned advocate for the petitioner challenges the order dated 08.12.2022 passed by the learned Judicial Magistrate, 1st Court, Barrackpore in M. Case No.56 of 2021.

The petitioner has approached this Court at a belated stage. There are statutory provisions which are to be exhausted before invoking the jurisdiction of this Court under the relevant provisions. Petitioner did not exhaust such process of law and the enclosures at least do not reflect the same.

As such, no interference is called for. Petitioner would be at liberty to exhaust the statutory provisions of law before the learned Magistrate.

Accordingly, CRR 188 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
