Matter relates to transfer of the petitioner who is working as Peon (Group-D) in a Government aided secondary school. Transfer Application was made on medical ground since wife of the petitioner is suffering from ailment. An application for transfer was made on Utsashree Portal on 1st February, 2022 and same was forwarded by the school authority where petitioner is presently working to the concerned District Inspector of Schools (SE).

District Inspector of Schools (SE) in his turn has processed the transfer application and forwarded the same to the West Bengal Central School Service Commission on 22nd March, 2022 for

taking final decision. Grievance of the petitioner is in spite of receipt of transfer application far back on 22nd March, 2022 till date same has not been decided.

Respondents are represented by learned advocates who have submitted jointly that due to suspension of portal with effect from 29th September, 2022 till date transfer application could not be decided.

However, on behalf of Commission it is submitted if appropriate authority is directed transfer application of the petitioner shall be decided in accordance with law.

Having considered the submissions made on behalf of the parties writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no. 4 to decide the transfer application of the petitioner by 8 (eight) weeks from the date of communication of this order and same shall be communicated to the petitioner by 10 (ten) days thereafter.

It is made clear that suspension of portal shall not be a ground to reject the transfer application of the petitioner.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
