Galib Mr. Subhra Nag ........ for the State The petitioner prays for implementation of the order dated 24th October, 2019 passed by the Block Development Officer, Sonarpur upon consideration of the order passed by this Hon'ble Court on 29th July, 2019 in W.P. No. 11251(W) of 2019.

By the said order the Block Development Officer was of the opinion that necessary action regarding demolition of the relevant encroachment of the public road has to be taken up by the appropriate authority.

The Sub-Divisional Magistrate and SubDivisional Officer, Baruipur, South 24 Parganas by a communication dated 18th November, 2020 has given instructions that the Executive Agency for conducting the said work is the Assistant Engineer, P.W.D. (Roads), Baruipur Sub-Division under control of the Executive Engineer, P.W.D.

(Roads), South Parganas Division.

As a considered opinion has been formed by the Block Development Officer that there has been encroachment of the Government land, accordingly, the instant writ petition is disposed of by directing the District Magistrate, South 24 Parganas to depute the competent authority to take necessary steps for removal of the encroachment of the Government land, in accordance with law, at the earliest, but positively within a period of six months from the date of communication of a copy of this order.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
