1. This intra court appeal by the writ petitioner is directed against the order dated 16.10.2023 in WPA 5081 of 2023.

2. There is a delay of 61 days in filing this appeal though there is no separate application for condonation of delay.

3. The learned advocate for the appellant prayed that the delay may be condoned since the delay is mere marginal.

4. We have heard the learned advocate for the respondents on the above submission.

5. Considering that the delay is only 61 days, the same is condoned.

6. In this appeal the appellant participated in the tender invited by the respondents and the appellant's technical bid was rejected.

7. The appellant's grievance before the writ court was that he wanted to download the documents of

other bidders for the purpose of challenging the same but the same was not available in the portal.

8. Therefore, sought for issuance of a Writ of Mandamus.

9. The learned Single Bench rightly declined to grant the relief noting that after the appellant had participated in the technical bid and the same having been rejected, he does not have any right to access or download the documents furnished by the other bidders.

10. That apart, it is informed by the learned advocate for the respondents that the tender was for a period of one year, it has already been allotted and the supply had been effected.

10. Thus. we find no grounds to interfere with the order passed by the learned Single Bench and the same is dismissed.
