The petitioner is claiming that his mother was working as an unorganized labour under the "Bhabishya Nidhi Prakalpa", a scheme of the Labour Department, Government of West Bengal; as such, was entitled to the benefit of "Samajik Surakasha Yojna".

The petitioner is praying disbursement of the money accrued to his mother under the said Yojna in his favour. A dispute was cropped up as to whether the said unorganized worker, namely Smt. Ira Roy was the mother of the petitioner.

The said dispute was referred to the Assistant Labour Commissioner, Barrackpore, district: 24-Parganas (North), the respondent no. 3 herein; to resolve it, the said respondent had conducted an enquiry to which the petitioner had participated.

The petitioner is complaining that no decision has been arrived at till date and is praying a direction over the said respondent for disposal of the said issue.

Mr. Manas Kundu, learned advocate for the State submits that the respondent no.3 has disposed of the said issue, rejecting the claim of the petitioner that he is the son of

the said Smt. Ira Roy, and has communicated his decision to the Labour Commissioner, Government of West Bengal by his letter dated August 27, 2019.

Mr. Kundu files the copy of the said letter along with the instruction of his client; let those documents be kept with the record.

It appears that the grievance of the petitioner since has already been addressed; no further order need be passed in the instant writ petition.

The petitioner however is free to challenge the decision of the respondent no.3 in accordance with law. Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

W.P.A. 412 of 2020 is thus disposed of with the above terms and observations without any order as to costs.
