The present petition has been filed for expeditious disposal of proceeding under Order 21 Rule 11 of the CPC for execution of the Arbitration Award pending before the learned Additional District Judge, 6th Court at Alipore.

Affidavit of service filed by the petitioner is taken on record.

Learned counsel for the petitioner states that opposite party no. 3 has duly been served. Leaned counsel for the O.P. 3 has raised objection on the ground that in fact, the petitioner is not interested in expeditious disposal.

None has appeared for the opposite party no. 1 and 2.

The Court considers that expeditious and speedy disposal is a matter of right of the parties and also the duty of the parties.

The Court considers that no prejudice is being caused to either of the parties. If an appropriate direction is given to the expeditious disposal of the execution Case No. 691 of 2023, the learned Additional District Judge, 6th Court, Alipore is directed to dispose of execution Case 691 of 2023 expeditiously in accordance with law.

The petition stands disposed of.
