No.2 The application under Section 439(1B) of the Code of Criminal Procedure has been preferred challenging the condition imposed upon the petitioner to take permission prior to leaving the jurisdiction of the Court. Petitioner is aggrieved by such condition being imposed. Learned advocate appearing for the petitioner submits that he needs to go Mumbai for visiting the relations. Be that as it may, since the condition which was imposed was to take permission from the Learned A.C.J.M. Serampore prior to leaving the jurisdiction, I direct that in case such an application is filed by the applicant/petitioner detailing the place(s) of visit and its purpose. Learned Magistrate would after hearing the learned Public Prosecutor and/or any necessary

parties dispose of such application within a period of seven days. Learned Magistrate would consider such an application without being influenced by any revisional application pending before this Court. With the aforesaid observations, C.R.M.(SB) 13 of 2023 is disposed of.
