Heard learned Advocates for the parties.

Learned Advocate for the petitioner submits as follows. There was a scuffle that took place between the members of two adjacent families. Injuries were suffered on both sides, but none was grievous in nature.

Learned State Advocate strongly opposes the prayer for anticipatory bail. He relies on statements of witnesses and the injury report, which shows multiple linear non-displaced fractures noted in left temporal bone, subdural hemorrhage, multiple contusional hemorrhage noted in right temporal lobe. Considering the above, the other materials available in the case diary and the fact that petitioner nos. 4 to 7 are female members of the family, while I am inclined to grant anticipatory bail to the petitioner nos. 4 to 7, the prayer for anticipatory bail of the petitioner nos. 1, 2 and 3 is rejected.

Accordingly, in the event of arrest, the petitioners, namely, Anarkali Sk. @ Sk. Jamila Bibi, Nahis Bibi @ Najmun Nahar Begam, Sania Bibi @ Jesmin Bibi and Sanjida Khatun @ Sanjida Nahar shall be released on bail upon furnishing a bond of Rs. 10,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall not threaten or intimidate the witnesses and shall cooperate with the investigation.

The application for anticipatory bail is, thus, disposed of. ( Jay Sengupta, J. )
