This appeal has been preferred by the State of West Bengal against the judgment and the order of acquittal passed by the learned Judge, Special Court, E.C.Act, Coochbehar in Special E.C.G.R. Case No. 15 of 1984. What I perceive the learned Judge rendered the judgement after proper assessment and appreciation of the evidence.

I find no illegality in the judgment passed by the learned Trial Judge. As such I refrain from interfering with the judgment of the learned court below.

In view of the above, the appeal is dismissed. The judgment and the order of acquittal passed by the learned Judge, Special Court, E.C.Act, Coochbehar in Special Case No. E.C.G.R.Case No. 15 of 1984 is hereby confirmed. Let a copy of this order along with the Lower Court records be sent down to the learned Court below. The appeal is disposed of accordingly.
