1. Complaining illegal construction at premises No. 137/8/10 Raja Rajendra Lal Mitra Road, P.O. and P.S. Beliaghata, Kolkata 700010, the instant writ petition has been filed.

2. Mr. Nayek, learned advocate appears for the municipality. He has placed before this Court the report dated 8th January, 2026 prepared and counter signed by the Sub-Assistant Engineer (c), Assistant Engineer (c) and the Executive Engineer (c), Building department borough III. From the aforesaid report, it would transpire that unauthorized construction without sanction building plan from the municipality, has been carried out at premises No.137/H/10 Raja Rajendra Lal Mitra Road, P.O. and P.S. Beliaghata, Kolkata 700010. From the aforesaid report, it also appears that a stop work notice under Section 401 of the

WPA 1188 of 2025 KMC Act, 1980 (hereinafter referred to as the said Act) was served on the person responsible. A proceeding has also been initiated under Section 400 of the said Act.

3. Having regard to the aforesaid report, I am of the view, there is no necessity to keep the writ petition pending.

4. Accordingly, the writ petition is disposed of with the direction upon the municipal authority to ensure that the proceedings initiated by the municipality are brought to a logical conclusion as expeditiously as possible preferably within a period of 8 weeks from the date of communication of this order.

5. With the above observations and directions, the writ petition is disposed of.
