Learned counsel for the petitioner has pointed out that the Sub-Divisional Officer, Haldia has already passed the order dated 10.04.2019, annexure P-4, directing the Sub-Divisional Magistrate, Haldia to remove encroachment from the village road and also directing the Station Manager, Mahishadal CCC, WBSEDCL to take steps for shifting the electric line from the concerned lane.

He submits that in spite of passing the order, no steps have been taken to give effect to the said order, therefore the petitioner has filed the representation dated 20.04.2021 before the Sub-Divisional Officer, Haldia, the respondent No.5 herein, which is pending, but in that representation also no action has been taken. Learned counsel for the State has fairly submitted that there is no objection in considering the petitioner's representation and taking appropriate steps.

WPA (P) 24 of 2022 Hence, we dispose of the present petition by directing the respondent No.5, Sub-Divisional Officer, Haldia to duly consider the petitioner's representation dated 20.04.2021 and take appropriate action in accordance with law as expeditiously as possible preferably within a period of 3 months from the date of receipt of a copy of this order.

The present petition is accordingly disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
