On prayer of the petitioners liberty is granted to correct paragraphs 3, 4 and 5 of the writ petition by incorporating respondent No. 7 instead of respondent No. 8 stated therein.

The petitioners contend that their land has been utilised by the State respondents for construction of embankment at Mouza Bagdanga but the land has neither been acquired nor compensation paid to the petitioners for the same. The petitioners submitted a representation in this regard before the concerned authority on 2nd August, 2021 and pray for direction upon the authority to consider the representation at the earliest.

It is submitted on behalf of the State respondents that the 7th respondent be directed to consider and dispose of the representation submitted by the petitioner in accordance with law.

In view of the above, the writ petition is disposed of directing the 7th respondent to consider and dispose of the representation submitted by the petitioners dated 2nd August, 2021 within two months from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
