1. This criminal revisional application has been filed assailing the judgment and order dated 21.09.2016 in connection with Session Trial No. 1(12) of 2013.

2. The petitioner was arrayed in a case being Jalangi P.S. Case No. 383 of 2011 dated 25.04.2011 under Sections 325/307/506 of the Indian Penal Code. After investigation chargesheet was submitted under Section 325/307/506 of the Indian Penal Code against the accused. After commitment of case, the same was transferred to the Court of learned Additional Sessions Judge, 1st Fast Track Court, Berhampore, Murshidabad. Learned Judge after trial found the petitioner/Sujit Mukherjee guilty of committing offence punishable under Section 323 of the Indian Penal Code and sentenced him to undergo a simple imprisonment

for one day and to pay compensation of Rs.10,000/- to the victim, in default to which the victim got every right to recover the amount by application before this Court.

3. Learned counsel appearing on behalf of the petitioner has submitted a challan showing payment of compensation of Rs.10,000/-. Let the same be kept with the record.

4. Given facts and circumstances, the sentence imposed on the petitioner be reduced to only on compensation of Rs.10,000/-

5. Accordingly, the petitioner/accused be discharged from his bail bond and be set at liberty.

6. With the aforesaid observation the revisional application stands disposed of.

7. Connection application also stand disposed of.

8. Lower Court Record be send back.

9. All parties shall act on the server copies of this order duly downloaded from the official website of this Court 10.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
