Parveen ... for the Petitioner(s) Ms. Sreyashee Biswas Mr. Raju Mondal ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case relates to alleged recovery of 15 bottles of phensedyl.

Learned advocate also submits that the petitioner has been implicated along with the similarly placed four accused persons and charge-sheet has already been submitted against the twenty accused persons. Additionally, it has been submitted that the petitioner is in custody for more than four months and the investigation has been completed, as such, on any stringent condition, the petitioner may be released on bail. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that date has been fixed for supply of copies in the month of March, 2026.

Having considered the quantum of seizure and the period of detention of the present petitioner, I am of the view that further custodial detention of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Suraj Karmakar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act-cum-learned Additional District Judge, 3rd Court, Malda.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Malda without prior intimation to the learned trial court. Accordingly, CRM(NDPS) 130 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
