At the time of call Dr. Patra, learned advocate representing the West Bengal Central School Service Commission undertakes to file the report in terms of the previous order of this Court in course of this day. However, copy of the report has been placed before this Court by Mr. Dasgupta, learned advocate representing the petitioner and the same shall be retained on record till the report is filed on behalf of the Commission.

On perusal of paragraph 5(f), it appears that the Commission has treated the mistake crept in in the mark sheet of B.Ed. examination as minor mistake, the Commission is ready to treat the petitioner as a trained candidate since the petitioner disclosed his training qualification with marks in the original online application dated 30th September, 2016.

In view of the aforesaid averments made in the report of the Commission, the writ petition stands disposed of directing the Commission to treat the petitioner as a trained candidate and appraise the candidature of the petitioner in accordance with law and in that event, petitioner comes within the zone of consideration in connection with 1st SLST, 2016 (Upper Primary), the petitioner shall be permitted to participate in the interview.

It is also clarified that if petitioner is found to be an eligible candidate after his participation in the interview, consequential steps shall be taken by the Commission.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
