Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. None appears for the private respondents despite service.

The petitioners seek a direction upon the police to cause investigation and submit a report in terms of the order dated 1st September, 2023 passed by the learned Chief Judicial Magistrate, Howrah in M.P. case no. 1105 of 2023 and order dated 22nd July, 2025 in M.P. case no. 170 of 2025.

Learned counsel for the petitioners submits that after the writ petition was filed, the police authority has submitted a report before the learned Chief Judicial Magistrate on 20th January, 2026 demonstrating that no cognizable offence has been made out.

The report submitted by the State also demonstrates several litigations, both civil and criminal, pending between the parties.

In view of the above, nothing further remains to be dealt with in the writ petition. The same is accordingly disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
