This contempt application has been filed alleging willful disobedience of the order dated 19th September, 2024 in W.P.A.(P) 394 of 2024.

A report has been filed by the Block Land & Land Reforms Officer, Panskura - II at Kolaghat dated 28th February, 2024 from which it is seen that the first limb of the direction has been complied with. The report be taken on record.

The contention urged by the learned advocate appearing for the applicant is that there is another direction issued in the writ petition directing action to be taken against the illegal and unauthorized construction for which no action has been taken. Certain photographs have also been produced before this Court. 4.

As could be seen from the annexure to the written instruction given by the Block Land & Land Reforms Officer, a communication has been sent by the District Land & Land Reforms Officer, Purba

Midnapore to the Executive Officer, Kolaghat Panchayat Samity on 6th January, 2025 to take action under the Panchayat Act and Rules against the unauthorized construction. It appears that the same has not been complied with till date.

In the light of the above, let a copy of this order be forwarded to the Executive Officer, Kolaghat Panchayat Samity, Kolaghat, Purba Midnapore with a direction to the said Panchayat to comply with the order passed by this Court and also the findings as recorded by the B.L. & L.R.O., Panskura - II, Kolaghat after notice to all concerned. In order to ensure that the order is complied with in its letter and spirit, an appropriate action is to be taken. 6.

Let a copy of this order be forwarded to the District Magistrate, Purba Midnapore by the Registry of this Court so that the entire matter can be monitored.

Action be taken by the Kolaghat Panchayat Samity within a period of four weeks from the date of receipt of server copy of this order to be communicated by the Registry of this Court. 8.

With the above direction, contempt application stands disposed of. 9.

No costs.

10. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
