This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 21(C) and 29 of the NDPS Act.

Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. He is in custody since 15.09.2019, the date on which the FIR was registered. Charge sheet was submitted on 29.01.2020 citing eight prosecution witnesses. A chemical report was also filed thereafter by way of a supplementary charge sheet dated 30.09.2020. However, till date even charges could not be framed. The matter has remained pending for no fault on the part of the present petitioner.

I have heard the submission of the learned counsel appearing on behalf of the petitioner and have perused the revision petition. It appears that some delay has been occasioned in disposing of the proceeding, especially considering the fact that the petitioner is in custody since 15.09.2019.

In view of the above and in the interest of justice, the learned Court is requested to conclude the trial as expeditiously as possible without granting any unnecessary adjournment to any of the parties and in particular, to decide the question of framing of charge at the earliest, preferably within a period of two months from the resumption of normal functioning of the learned Trial Court.

With the above observations, the revisional application is disposed of.
