1. In spite of service, none appears for the added respondent no. 4.

2. The account of the petitioner, which has been frozen by the respondent no. 1 on account of certain pending investigation before the respondent no. 4, cannot be ascertained in absence of the respondent no. 4.

3. The petitioner, however, informs that the respondent no. 4 has orally communicated that there is no pending case insofar as the petitioner's account with the State Bank of India baring no. xxxxxx38227339.

4. The petitioner is granted liberty to communicate with the respondent no. 4 and if indeed there is no such pending case, the communication of the respondent no. 4 to such extent to the petitioner will be forwarded to the State Bank of India, who will act on such communication and defreeze the

account.

5. However, if no such communication is received, the State Bank of India will be under no obligation to defreeze the account.

6. With the aforesaid direction, the writ petition is disposed of.

7. There shall, however, be no order as to costs. (Reetobroto Kumar Mitra, J.)
