The petitioner claims that the private respondent has forcibly entered into his property, which is under construction.
A complaint dated 7th December 2021 has been made to the Bidhannagar South Police Station. Learned counsel for the State has produced a report dated 9th June 2022, issued by the Officer-inCharge, Bidhannagar South Police Station, which is taken on record.
It appears from the report that the issue was inquired into and there is a title dispute to the property. The police could not resolve the dispute as to who the owner of the property in question is. The police, in fact, cannot do so.
Be that as it may, the petitioner may approach the Civil Court against the private respondent.
There is no inaction on the part of the Bidhannagar South Police Station. The Bidhannagar
South Police shall, however, ensure that there is no breach of peace in the area.
With the aforesaid directions, the writ petition is disposed of.
There shall be no order as to costs.
