Learned counsel appearing on behalf of the appellants submits on written instruction that the respondent/tenant has already vacated the suit premises as settlement between the parties is arrived at and further that one of the appellants Dalia Sarkar expired on 01.02.2020, and to that effect a death certificate has been produced before this Court.

Let it be kept with the record.

Since the parties had already settled outside the court and the suit premises has been vacated voluntarily by the tenant/respondent. The Second Appeal being SA 494 of 1997 is disposed of.
