The petitioner seeks higher scale of pay on account of enhancing his educational qualification. His request forwarded by the school authority where he was previously serving is pending consideration before the District Inspector of Schools (Secondary Education), Purba Medinipur.

The present school where the petitioner is teaching falls within the jurisdiction of the District Inspector of Schools (Secondary Education), Paschim Medinipur.

There is nothing on record to suggest that the request for grant of higher scale of pay was made before the District Inspector of Schools (Secondary Education), Paschim Medinipur.

In view of the above, leave is granted to the petitioner to make a comprehensive representation before the District Inspector of Schools (Secondary Education), Paschim Medinipur.

In the event such a representation is made, the same shall be considered by the District Inspector of Schools (Secondary Education), Paschim Medinipur in accordance with law after giving a reasonable opportunity of hearing to the petitioner for production of all documents in support of his claim for higher scale of pay.

A reasoned order shall be passed by the aforesaid respondent at the earliest, but positively within a period of twelve weeks from the date of filing of such representation.

If the claim of the petitioner is allowed, then necessary consequential steps for releasing the higher scale of pay shall be taken by the aforesaid respondent. 9.
The writ petition stands disposed of.
10.
All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.
11.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
