Learned advocate appearing for the petitioners submits that the first petitioner is the husband. The first petitioner was sending a sum of Rs. 3,000/- per month to the de facto complainant. The de facto complainant left the matrimonial home eight months ago.

Learned advocate appearing for the State draws the attention of the Court to the contents in the case diary. On query from Court, learned advocate appearing for the petitioners submits that there is a child of four years from the wedlock. The child is with the mother.

Considering the materials in the case diary, gravity of the offence and the involvement of the petitioners, we are not inclined to grant anticipatory bail to the petitioner no. 1, Rajat Das. However, we are inclined to grant anticipatory bail to the petitioner nos. 2, Jali Das, 3, Rina Das and 4, Sanu Das.

Accordingly, we direct that in the event of arrest the petitioner nos. 2, 3 and 4 shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner nos. 2, 3 and 4 shall appear before the Court below and pray for regular bail within a period of four weeks from date and on further condition that the petitioner no. 4 shall report the Investigating Officer once in a month till completion of investigation and petitioner nos. 2 and 3 shall cooperate with the investigation.

Prayer for anticipatory bail is partly allowed. CRM (A) 298 of 2022 is disposed of.
