Tarak Roy @ Dipendra Roy v. State Of West Bengal
D/L 24 10.02.2026 Bpg.
C.R.M. (M) 187 of 2026 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Madhyamgram Police Station Case No.703 of 2025 dated 08.09.2025 under Sections 103(1)/238/3(5) of Bharatiya Nyaya Sanhita, 2023; Tarak Roy Alias Dipendra Roy
Versus
The State of West Bengal Mr. Angshuman Chakraborty Mr. S.S. Saha.
...for the petitioner.
Mr. Abisekh Sinha Ms. Trisha Rakshit.
...for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 5 months and unnecessarily he has been implicated in connection with the instant case. There are no materials to substantiate which would call for further detention of the present petitioner.
Learned advocate for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the postmortem report including the injuries which have been sustained by the deceased as also the fact that motive is established as there was dispute relating to the certain monetary transactions. Having considered the gravity of the offences and the fact that the matter is still before the learned Magistrate and yet to be committed, at this stage, I am not inclined to release the petitioner on bail.
Accordingly, CRM(M)187 of 2026 is dismissed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
