2022-06-08Hon'Ble Justice Tirthankar Ghosh2 pages

C.R.R. No.190 of 2022 D/L29 June 8, Bpg.

In Re: A petition under Section 397/401 read with Section 482 of the Code of Criminal Procedure;

Rita Das

Versus

The State of West Bengal & Ors.

Mr. Nimai Ray, Mr. Arnab Chatterjee, Ms. Piu Roy.

...for the petitioner.

Mr. Saswata Gopal Mukherjee, Ld.P.P., Mr. Saryati Datta.

...for the State.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that purpose for which the revisional application was preferred before this Court has ultimately materialised and presently victim's evidence is in progress before the learned Special Court.

Learned Public Prosecutor submits a report which reflects that service has been effected upon the private opposite party nos.2 and 3.

Let the report be kept with the record.

In view of the submissions advanced by the petitioner as well as the State, I am of the opinion that as the case was initiated in the year 2020, the learned Special Court would fix at least one date in a fortnight so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 190 of 2022 is

disposed of.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
