Dudhoria, learned advocate appearing for the petitioner and Mr. Banerjee, learned advocate representing the alleged contemnor in this contempt application against the alleged violation of the order of this Court dated 12th August, 2022.

Mr. Banerjee submits that the department has not gone into appeal against the aforesaid order of this Court and the alleged contemnor is ready and willing to comply with the order of this Court and the aforesaid delay in compliance of the order of this Court is only due to non-compliance of some formalities by the petitioner by submitting the documents indicated in the letter dated 2nd February, 2023 by the alleged contemnor.

Considering the submission of the parties this matter is adjourned for four weeks. Petitioner shall

furnish to the alleged contemnor all the documents asked for by the letter dated 2nd February, 2023 within two weeks from date and the alleged contemnor must refund the excess duty collected as indicated in the aforesaid order of this Court positively within two weeks from the date of receipt of such documents.
