For the State Leave is granted to the learned Advocate-onRecord for the petitioner to carry out necessary corrections in the cause title of the petition. The petitioner alleges unauthorized construction at the instance of respondent No. 9 in respect of Plot No. 1146, Mouza-Joyrampur, J.L. No. 232, Police Station-Daspur, District-Paschim Medinipur.

The petitioner acknowledges that respondent No. 9 is one of the co-owners of the plot in question. It is further contended that respondent No. 9 has commenced construction on the said plot without obtaining prior permission from the competent Panchayat authority. A report has been filed on behalf of the State. From the said report, it appears that respondent No. 9 had submitted an online application seeking permission to construct the building in question; however, the same was rejected by the Panchayat on January 28, 2026. Respondent No. 9 was further directed by the Panchayat not to proceed with any construction activity unless and until due permission was duly obtained.

Let the report filed on behalf of the State be kept on record. A copy thereof has been furnished to the learned advocate for the petitioner.

In view of the categorical stand taken by the Panchayat, this Court finds no justification to keep the writ petition pending. Accordingly, WPA 1316 of 2026 stands disposed of with a direction upon the Pradhan, Palashpai Gram Panchayat (respondent No. 7), to ensure that respondent No. 9 does not undertake any construction without obtaining requisite permission from the Panchayat authority.

It is, however, made clear that the Panchayat shall be at liberty to consider the application of respondent No. 9 for sanction of a building plan in accordance with law.
