In Re: CAN 3 of 2022 This is an application for consideration of the representation dated August 16, 2022 made by the incumbents for promotion to the vacant posts of 'Record Arrangers' from the posts of 'Duftry'. On January 6, 2023 the promotional examination for filling up such vacant posts was scheduled to be held. Thereafter, the said examination was held after rescheduling of the same.
From a report filed by the Registrar General of the Hon'ble High Court at Calcutta affirmed on May 11, 2023, it appears that on May 3, 2023 all the 18 vacancies for 'Record Arrangers' and 11 vacancies in the post of 'Duftries' were filled up. Subsequently, 3
vacancies arose for the post of 'Duftries' and 2 vacancies arose for the post of 'Record Arrangers'. The incumbents/petitioners may be considered for promotion to the vacant posts of 'Record Arrangers' as and when the High Court Administration takes a decision for filling up of the same, subject to compliance of the formalities.
Mr.
Bhattacharyya, learned senior counsel appears on behalf of the petitioners/applicants. He submits that out of the 6 petitioners, the petitioner no.6 has already been selected and 2 petitioners have already retired from their services.
Mr. Kar, learned senior counsel appears on behalf of the High Court Administration.
Considering the rival submissions of the parties and the materials placed on record, this Court directs the representation dated August 16, 2022 to be disposed of by the Registrar General within a period of 8 weeks from date upon giving a personal hearing to the petitioners. The reasoned order may be passed and communicated to the petitioners within 2 weeks of passing thereof.
With the directions aforesaid, CAN 3 of 2022 is disposed of.
In Re: WPA 438 of 2020 By consent of parties, the main writ petition, being WPA 438 of 2020, is taken up consideration. The same is disposed of with the order that as and when the vacancies to the post of 'Record Arrangers' are decided to be filled up, the petitioners will be entitled to apply and if found eligible, will be considered for promotion, in accordance with law. The said order is passed by consent of the parties without going into the merits of the writ petition.
With the directions aforesaid, WPA 438 of 2020 is disposed of.
