Pandey ....for the respondents no. 1, 3, 4, 5 The grievance of the petitioner is directed against the wrongful installation of a high voltage electricity connection on the premises belonging to the petitioner. It is submitted by the Advocate appearing on behalf of the petitioner that the petitioner made a representation to the concerned District Magistrate and the same is still pending for disposal.
The WBSEDCL is represented and submits that the impugned installation is being carried out by the West Bengal State Electricity Transmission Company Limited (in short, "WBSETCL") who has not been impleaded as party respondent in this petition.
It is submitted on behalf of the petitioner that in compliance of the order dated February 25, 2021 the WBSETCL has been impleaded as party respondent in this petition but the WBSETCL is not represented despite service.
In view of the submission made on behalf of the parties I direct that the District Magistrate, being the respondent no. 2 herein to dispose of the representation of
the petitioner dated January 12, 2021 (appearing at page 46 of this writ petition) within a period of 8 weeks from date after giving a right of hearing to the petitioner and all affected parties including the WBSETCL and to pass a reasoned order.
I make it clear that I have not gone into the merits of this case and all points are left open to be decided by the respondent no. 2 without influenced by any observation made in this order.
I make it clear that the pendency of the representation of the petitioner will not interfere with the rights of the respondents in carrying out their statutory duties.
In view of the above, WPA No. 1369 of 2021 is disposed of.
There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
