Mr. Soumyajit Das Mahapatra ... For the petitioner. Mr. Soumitra Bandopadhyay, Mr. Priyabrata Batabyal... For the State respondents. The petitioner is complaining delay in disbursement of the amount of compensation awarded in his favour in L.A. Case No. NH - 01 of 16-17.

It appears from the record that the petitioner has already furnished bank account in which the said amount was instructed to be disbursed.

Mr. Soumitra Bandopadhyay, learned counsel appearing on behalf of the State respondents submits that the respondent no. 7 has received a notice from the learned advocate of one Mathur Chandra Dutta, whereby the said person has informed the respondent no. 7 that there is a suit pending between him and the petitioner over the title of the acquired land and prayed that the awarded compensation may not be disbursed in favour of the petitioner and in view of the said objection, the respondent no. 7 is unable to disburse the said compensation in favour of the petitioner.

Mr. Soumyajit Das Mahapatra, learned advocate for the petitioner submits that the suit referred to in the said notice has already been withdrawn.

Be that as it may, W.P.A. 1386 of 2021 is disposed of by directing the respondent no. 8 to consider the prayer of the

petitioner for release the compensation awarded in his favour in the aforementioned acquisition case in accordance with law.

Since no affidavit-in-opposition has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents There shall be no order as to costs.
