1. Affidavit-of-service filed in Court today be kept on record.

2. Despite service, none appears for the respondents at the time of call.

3. The petitioner is a cultivator. Due to nonpayment of electricity dues, his electricity connection was severed.

4. The petitioner seeks some time to pay off the dues for the purpose of restoration citing the ongoing cultivation season.

5. Heard learned counsel for the petitioner.

6. In view of the financial stringency of the petitioner, who is a cultivator, the matter is required to be considered somewhat sympathetically.

7. Accordingly, WPA No. 1089 of 2024 is disposed of by directing the petitioner to pay off the entire electricity charge dues to the

tune of Rs.75,336/- by two equal monthly installments. The first of such installments shall be paid by March 15, 2024 and the next by April 15, 2024.

8. Upon the first installment being paid, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) shall restore the electricity supply of the petitioner on condition that the petitioner pays the balance amount by way of second installment on or before April 15, 2024.

9. It is made clear that the petitioner shall go on paying the current electricity charges after restoration of electricity supply.

10. In the event of non-payment by the petitioner of the second installment within the stipulated time, it will be open to the WBSEDCL to disconnect the electricity supply of the petitioner.

11. It is made clear that this order shall not be treated as precedence in future matters.

12. There will be no order as to costs.

13. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
