Learned counsel for the petitioner submits that, due to resistance being put up by the private respondent no. 4 and his men and agents, the CESC Limited personnel were unable to hold an inspection in the petitioner's premises for the purpose of giving a new electric connection at the existing meter board. Such stand is corroborated by learned counsel appearing for the CESC Limited.

Learned counsel appearing for the private respondent no. 4, on instruction and in his usual fairness, submits that there was a misunderstanding on the part of the private respondent no. 4 when the CESC

Limited personnel came to inspect the meter board. However, the respondent no. 4 has no objection now, in principle, to such new electric connection being given in the name of the petitioner at the premises.

Accordingly, WPA No. 1042 of 2022 is disposed of, thereby directing the CESC Limited to hold appropriate inspection for the purpose of giving a new electric connection to the petitioner and, thereafter, to give such connection to the petitioner, subject to compliance of all formalities by the petitioner, preferably within three weeks from the compliance of such formalities by the petitioner at the existing meter board position.

It is expected that the private respondent no. 4 shall co-operate in such inspection and in the new connection being given, in view of the concession given by the private respondent no. 4 through counsel in Court today.

The CESC Limited personnel are requested to intimate the petitioner as well as the respondent no. 4 the date of inspection prior to holding such inspection and giving the new electric connection to the petitioner. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
