Petitioner complains that he is unable to stay at his home because of the attrocity being inflicted on behalf of the private respondents who with the aid of the deadly weapons are threatening the petitioner. Learned advocate appearing for the State has submitted a report which reflects that number of criminal cases are pending against the present petitioner at Rajarhat Police Station.

Having considered that the investigation relating to the said cases are in progress and the jurisdictional court is in seisin of the said criminal cases, if the petitioner has faced any resistance or is insecure in staying at his residence, petitioner would make an application before the jurisdictional magistrate who is in

seisin of the Rajarhat P.S. Case No.363/24, Rajarhat P.S. Case No.54/23, Rajarhat P.S. Case No.417/24, Rajarhat P.S.

Case No.445/24.

The concerned magistrate would assess regarding the genuinity of the accusations and in case the petitioner is unable to stay at his residence, pass necessary directions upon the police authorities.

With the aforesaid observations, the writ petition being WPA No. 1333 of 2025 is disposed of.

The report submitted be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
