The Officer-in-Charge, Palashipara Police Station has filed a report indicating that the death certificate was issued by the Sub-Register, Death & Birth, Sahabnagar Gram Panchayat, Chotonalda, Nadia. The death occurred on February 5, 2018 and the factum of death was registered on November 27, 2018.
According to the Officer-in-Charge, Palashipara Police Station, the place of occurrence was Amtala village which is under the jurisdiction of Officer-in-Charge, Nowda Police Station. It appears that the petitioner also filed an application under Section 156(3) of the Cr.P.C. before the jurisdictional magistrate for a direction upon the competent police authority to register a case. The specific allegation of the petitioner was that the son of the petitioner had been murdered. A representation was also made before the Officer-in-Charge, Nowda Police Station
and also the Superintendent of Police, Murshidabad. The police report is taken on record.
This writ petition is disposed of with a direction upon the Superintendent of Police, Murshidabad to ensure that the appropriate jurisdictional police station takes immediate steps on the basis of the complaint filed by the petitioner and conducts the investigation in a free, fair and impartial manner. This order shall not be construed as an observation on the correctness of the allegations of the petitioner. However, the investigating agency shall do the needful in accordance with law.
The writ petition is disposed of.
There shall be no order as to costs.
