Learned counsel appearing on behalf of the petitioner submits that other than the statements of a co-accused, there are no incriminating materials available against the present petitioner. Charge sheet has been submitted.
Learned counsel appearing on behalf of the NCB opposes the prayer for anticipatory bail. He submits that apart from the statement of the co-accused, there are CDR records showing phone calls made between the petitioner and the principal accused at the relevant time. Moreover, the petitioner did not respond to the notices given. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
