The learned advocate appearing for the petitioner has handed over seven cheques of an amount of about Rs.29,000,00/- (Rupees twenty-nine lakhs) to the de facto complainant, who is personally present before this Court. Let the photostat copies of the said cheques as handed over be kept on record. Mr. Ahmed, learned advocate appearing for the de facto complainant also hands over an acknowledgement pertaining to the said cheques. Let a copy of the same be kept on record. As a substantial amount, through postdated cheques, has been secured, we are of the opinion that custodial interrogation of the petitioner is not warranted in the facts and circumstances of this case.

Accordingly, we direct that in the event of arrest, the petitioner, namely, Kingsuk @ Kingshuk Rakshit shall be

released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

Accordingly, the application for anticipatory bail being CRM No.474 of 2021, is allowed.
