The petitioner seeks implementation of the order passed by the Bally Municipality on 17th October, 2023. None represents the private respondents.

Affidavit-of-service filed today be kept with the records.

It appears from the order sheet that the Municipality has detected unauthorised construction and directed the person responsible to remove/demolish the same.

As the person responsible failed to demolish/remove the unauthorised portion of the construction made at 198, Bhattanagar, Liluah, Howrah within the time limit as specified in the order, accordingly, the municipality is directed to take steps to remove/demolish the same and recover the cost of demolition from the person responsible for making the construction.

The municipality shall take steps in the matter at the earliest but positively by 31st July, 2024.

It will be open for the municipality to seek assistance from the concerned police station. The police will be responsible to remove the occupants and vacate the structure constructed unauthorisedly.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
