The petitioners allege that the order dated August 24, 2023 passed by this court in WPA 1055 of 2022, which relied on a previous Division Bench order passed in MAT 1793 of 2023 and directed the railway authorities to remove the cradle guard and re-position it sufficiently above the top of the roof of the petitioners' property as indicated in the sketch map annexed at page-28 of the said writ petition and in terms of the order dated November 09, 2006 passed in MAT 1793 of 2023, has not been complied with. It is alleged that the cradle guard has been placed immediately above the roof of the petitioners, thereby posing serious risk of life and limb to the petitioners and their families. 2.

Since a sufficient prima facie case of contempt has been made out, the petitioners shall serve copies of the contempt application on the alleged contemnors indicating that the matter shall be listed on May 17, 2024 under the same heading when the petitioners shall file an affidavit-of-service to that effect.
