1. Affidavit of service, as filed, be kept with the record.

2. The petitioner is aggrieved with a sale notice issued by the respondent-bank under the Security Interest (Enforcement) Rules, 2002 (in short, the said Rules).

3. Mr. Kali, learned Advocate appearing for the petitioner submits that the petitioner is ready and willing to settle the loan given by the respondent-bank.

4. The petitioner will be at liberty to present a repaymentschedule by 28.01.2026 with the respondent-bank which the bank will consider and dispose of by 05.02.2026.

5. The Bank will duly communicate such decision on the representation of the petitioner by 06.02.2026.

6. The petitioner has an alternative and efficacious remedy to ventilate his grievance before the Debts Recovery Tribunal. The writ-petition or the representation will not impede the rights of the petitioner to approach the Debts Recovery Tribunal for redressal of his grievances.

7. With the afore-stated directions, WPA 1232 of 2026 is disposed of. No order as to costs.

8. Urgent Photostat Certified Copy of this order, if applied for, be given to the parties.
