-Versus- The State of West Bengal & Others Mr. Sayan Banerjee Ms. Suparna Dutta Mr. Sayed Hussain Ms. Tusi Naskar ..for the petitioners Ms. Sipra Mazumdar Ms. Somasree Dey ....for the State respondents 1) Affidavit of service filed on behalf of the petitioners is taken on record.

2) Document filed on behalf of the petitioners relating to payment of deficit Court Fees is also taken on record 3) Petitioners are working as IT personnel (Data Entry Operators /Computer Operators) in different Government Health establishments on contractual basis.

Engagement of petitioners was made from 2021 onwards for limited period and such engagement was renewed from time to time.

4) Petitioners' common prayer is upgradation of their conditions of service based on notification dated 16th October, 2020 being no. 192 -IT/ 06/2020/P & AR-e- Gov issued by the

Additional Chief Secretary, Department of Personnel and Administrative Reforms, Government of West Bengal. It is further submitted in reference to a memorandum dated 31st May, 2022 which is at page 97 of the writ petition that similarly circumstanced 150 Data Entry Operators/ IT personnel were granted benefit of notification dated 16th October, 2020 on upgrading their service conditions accordingly.

It is also submitted that petitioners made representation dated 9th October, 2025 to the concerned respondent authority seeking benefit of notification dated 16th October, 2020.

5) State respondents are represented by learned advocate who submits that in the event representation is made seeking benefit of notification dated 16th October, 2020 same may be considered in accordance with law.

6) Having considered respective submissions made on behalf of the parties, Principal Secretary, Health and Family Welfare Department, Government of West Bengal being respondent no. 2 is directed to consider the representation of petitioners seeking upgradation of service conditions based on notification dated 16th October, 2020, by twelve

weeks from date of communication of this order after granting opportunity of hearing to one representative of the petitioners. Respondent no. 2 shall pass a reasoned order and same shall be communicated to the petitioners by fortnight thereafter.

7) Learned advocate representing petitioners is directed to communicate this order to respondent no. 2 enclosing a copy of the representation dated 9th October, 2025 addressed to the respondent no. 2 along with supporting documents by ten days from date.

8) Writ petition stands disposed of.

9) There shall be no order as to costs.

10) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
