The learned Counsel appearing on behalf of the respondent has produced a photostat copy of the order dated 11th May, 2022 from which it appears that the suit was dismissed for default on non-compliance of Courts orders.

In view thereof, this appeal has now become infructuous and the appeal, accordingly, stands dismissed.

The appeal is dismissed solely on the ground that the suit is dismissed for default in the meantime.

In view of the dismissal of the appeal, the connected application being CAN 1 of 2021 is also stand dismissed. We make it clear that we have not gone into the merits of the case.

A photostat copy of the order dated 11th May, 2022 produced by the learned Counsel for the respondent is taken on record.
