Mr. Bitasok Banerjee, learned advocate appearing for the State submits the documents which reflect that the trial of the case is in progress. Two of the witnesses have already been examined and discharged. Learned trial court has fixed date for evidence on 29th October, 2022.

Having regard to the stage of the case as submitted on behalf of the State, I am of the opinion that no interference can be made in respect of the continuation of the proceedings before the learned trial court.

Accordingly, CRR 110 of 2021 is dismissed.
