The petitioner seeks enhancement of maintenance granted in favour of the minor child of the parties to the tune of Rs.2000/- per month by an order passed on June 27, 2022 in M.Case No. 234 of 2021.

It is not in dispute that an execution case has been filed by the petitioner pursuant to the said order and the opposite party has been complying with the order till date. Since the petitioner seeks enhancement of the said amount due to subsequent change in the circumstances, the petitioner is at liberty to file appropriate application before the learned Trial Court in this regard in accordance with law within a fortnight from date. Upon the application being filed by the petitioner, the learned Trial Court shall decide the application upon hearing both the parties and considering the affidavits of assets and liabilities which may be filed by the parties before the learned Trial Court

and make all endeavours to dispose of the application as expeditiously as possible.

CRR No. 160 of 2023 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
