The petitioners, 28 in numbers participated in the 1st State Level Selection Test, 2016 for appointment in the post of Assistant Teacher in the subject Work Education in Upper Primary Level of Schools.

The grievance of the petitioners was that they have not been supplied with their respective marks in the written examination conducted by the West Bengal Central School Service Commission in relation to the said selection test. The Commission was directed to file report on the said allegation of the petitioners, in compliance thereof, the Commission has filed its report.

The Commission in its report dated July 05, 2023 has provided the marks obtained by the petitioners in the said written examination and has further disclosed that each of the petitioners had scored below the cut-off marks for being called in the personality test.

The petitioners have filed an exception to the report today, let it be kept with the record. The veracity of the finding in the report of the Commission that the petitioners have failed to score above the cut-off marks has been sought to be impeached by the exception to the said report but such challenge is beyond the scope of the writ petition, as such the said issue cannot be gone into in the present matter. The petitioners, however are at liberty to challenge the correctness of the said finding in accordance with law.

In view of the above, W.P.A. 1176 of 2023 is disposed of without any order as to costs.
