Ct. 19 sg Mr. Sandipan Maity Mr. Prithwish Guria ...for the petitioners Mr. Anuran Samanta Mr. Ramen Bose ...for the UOI Affidavit of service filed in Court is taken on record. The petitioners claim to be the owners of LR Plot No. 714, JL 38, within Mouza Kamarda, under Police Station Nandakumar, in the District of Purba Medinipur. The petitioners state that National Highway No. 116 is running adjacent to the aforesaid property of the petitioners. The petitioners submitted a representation dated 16th December, 2025 before the Project Director, National Highway Authority of India praying for granting lease of a portion of the highway land.

The learned Advocate appearing for the petitioners submits that in spite of receipt of such representation, no steps have been taken by the respondent authorities. The learned Advocate for the Union of India submits that the Project Director, National Highway Authority of India, being the second respondent, is the authority to consider such prayer.

Without entering into the merits of the claim made by the petitioners in the representation dated 16th December, 2025, WPA 1371 of 2026 stands disposed of by directing the Project Director, National Highway Authority of India,

Project Implementation Unit, Kolkata, being the respondent no.2, to consider the representation of the petitioner dated 16th December, 2025 after affording an opportunity of hearing to the petitioners or their authorized representative and to dispose of the said representation by passing a reasoned order and communicate such reasoned order to the petitioners as expeditiously as possible but positively within a period of eight weeks from the date of receipt of the server copy of this order.

Needless to mention that if the National Highway Authority of India decides to grant lease in favour of the petitioners, necessary steps shall be taken in accordance with law.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
