04.11.2022 Court No.12 Item no.06 B.M.J.R C.O 127 of 2020 State of West Bengal Vs.

Ganesh Das Ramgopal & Anr.

Mr. Supratim Dhar .... For the petitioner/State Mr. Satyajit Talukdar, Mr. Abhishek Sarkar .... For the O.P No.2/KMDA At the time of hearing Mr. Dhar draws attention of this Court to the order dated 11.08.2022 as passed in F.A 154 of 2011 by the Hon'ble High Court at Calcutta wherefrom it reveals that by the said order all further proceedings of L.A Execution Case No.2 of 2008 to 15 of 2008 have been stayed till disposal of the said appeals. It is submitted that in view of abovementioned order of stay, the present revisional application has become practically infructuous.

Mr. Takukdar, learned advocate for the KMDA, however, submits that in view of aforementioned order of the Hon'ble Court as passed in F.A 154 of 2011 the impugned order may be set aside.

On perusal of the entire materials placed before this Court and after hearing the learned advocates for the petitioner and the KMDA, this Court finds sufficient

materials in the submission of Mr. Dhar, learned advocate for the petitioner.

In view of such, C.O 127 of 2020 is hereby dismissed being infructuous. It is further made it clear that by disposing of this revisional application, this Court has not considered the merit of the instant revisional application.
