In terms of the order dated 2nd May, 2025, a report prepared by the District Inspector of Schools (S.E.), South 24 Parganas is filed today by the learned advocate representing the State respondents and same is taken on record.

On perusal of the report and the staff pattern of the school where petitioner is presently working annexed to the said report, it appears that it is true petitioner is not a single teacher in English in the school in question as there are other Assistant Teachers in English working in normal section, namely, Nirupam Pramanik and Abhijit Halder. Both the aforesaid Assistant Teachers in English have requisite educational qualifications for taking classes in Higher Secondary section. Therefore, petitioner though is a single teacher in English in Higher Secondary section should not be adjudged as a
single teacher in English in the school in question due to presence of the two aforesaid teachers of English in normal section having requisite educational qualifications to take classes in Higher Secondary section.

But fact remains that present roll strength of the school in question is 1200 where 19 teachers are working. Therefore, pupil teacher ratio is found to be poor, which does not permit any teacher of the school to be transferred on the ground of distance in between the school and residence of the teacher. 4.
Hence, no relief can be granted to the petitioner. 5.
However, if pupil teacher ratio of the school in question is improved, petitioner shall be at liberty to apply for transfer, in accordance with law.

Writ petition stands dismissed.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
