The petitioner complains of illegal and unauthorised construction at premises No. J-1/3D/1, Dhan Khety (Ram Nagar Lane), Ward No. 134, BoroughXV at the behest of the private respondents. Complaint lodged against such unauthorised construction is alleged to be kept pending.

Learned advocate representing the Corporation relies upon the instruction forwarded by the engineers of the Corporation signed on 29th April, 2024 which mentions that a departmental inspection was carried out and it was found that G+1 storied R.C.C. unauthorised illegal construction has been made. The owner of the building could not be identified. None represents the private respondents.

Affidavit-of-service filed today be kept with the records.

As it appears that unauthorised construction has been detected, the Executive Engineer shall take necessary steps to deal with the same in accordance with law.

Steps will be taken at the earliest but positively within a period of four months from the date of communication of this order.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
